Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your use of pixelsites.io and the website, branding, SEO, and hosting services provided by Pixelsites ("Pixelsites," "we," "us," or "our"). By using our site or purchasing a plan, you agree to these Terms. If you do not agree, please do not use our services.
2. What We Provide
Pixelsites offers done-for-you websites for local service businesses, including custom design, sales-focused copywriting, technical SEO setup, hosting, a branding package on select plans, and ongoing done-for-you edits. The exact deliverables depend on the plan you choose. We build sites on modern, performance-first technology and host them on Cloudflare.
3. Plans, Pricing & Payment
Our plans consist of a one-time setup fee plus a recurring monthly fee:
- One-Page — $29.99/month + $99 setup.
- 7-Page — $39/month + $399 setup.
- Multi-Page — $79/month + $599 setup.
The setup fee covers the full design, build, copywriting, any included branding, and launch of your site. The monthly fee covers hosting, maintenance, security, and the content updates included in your plan. We may agree to alternative billing arrangements (for example, a reduced or waived setup fee) in writing on an individual basis; any such arrangement will be confirmed with you before you are billed. Pricing is current as of the "Last updated" date and may change for new sign-ups; your active plan price will not change without notice. All fees are in U.S. dollars unless stated otherwise.
4. Billing, Renewal & Cancellation
Every plan is month-to-month with no contract. The setup fee is billed up front. The monthly fee recurs automatically each billing cycle until you cancel. You may cancel anytime with no penalty or cancellation fee by contacting gabriel@pixelsites.io. If we have agreed to an alternative billing arrangement in writing, its terms apply in addition to these. When you cancel, your monthly service (including hosting) ends at the close of your current billing period, and your website is taken offline. Your domain name always remains yours.
5. Refunds
Setup fees cover custom design and build work that begins as soon as you onboard, and are generally non-refundable once that work has started. Monthly fees are not pro-rated upon cancellation. If something is not right, reach out — we want you happy and will work with you in good faith.
6. Your Responsibilities
To build and maintain your site, you agree to:
- Provide accurate, complete business information and respond to onboarding requests in a timely way.
- Provide content, logos, and photos that you own or have the right to use.
- Keep your payment information current.
- Use your site and our services lawfully, and not for fraudulent, infringing, or harmful purposes.
Timelines (such as our typical 1–2 week launch) depend on you providing the needed materials. Delays on your side may extend delivery.
7. Content You Provide
You keep ownership of the logos, photos, text, and other materials you give us ("Your Content"). You grant Pixelsites a license to use, modify, and display Your Content as needed to design, build, host, and maintain your site. You are responsible for ensuring Your Content does not infringe anyone else’s rights and is not unlawful.
8. Intellectual Property
Your finished website content — your copy, your images, and your branding deliverables — is yours to use for your business. The underlying code, frameworks, design systems, and reusable components we use to build and operate sites remain the property of Pixelsites and its licensors. While your plan is active, you receive a license to use your hosted website. The Pixelsites name, logo, and pixelsites.io content are our property and may not be copied without permission.
9. Domain Names
If you already own a domain, we connect it to your site at no extra cost. If you don’t, we can register one for you, with registration and annual renewals included while your plan is active. Your domain is always yours. If you cancel, the site comes offline but your domain stays with you and can point to any other host, and we will help you move your content.
10. Third-Party Services
Our services rely on third-party providers such as Cloudflare (hosting and email), domain registrars, and a payment processor. Your use of those services may be subject to their own terms. We are not responsible for outages, changes, or actions of third-party providers outside our control.
11. SEO & Results Disclaimer
We build every site on a strong technical SEO foundation, but search rankings, traffic, leads, and bookings depend on many factors outside our control — including competition, Google’s algorithms, and your market. We do not guarantee any specific rankings, traffic, or revenue. Ongoing campaigns like link building or blog content are not part of the standard service unless agreed in writing.
12. Disclaimer of Warranties
Our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or completely secure.
13. Limitation of Liability
To the fullest extent permitted by law, Pixelsites will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or related to your use of our services. Our total liability for any claim relating to the services will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.
14. Indemnification
You agree to indemnify and hold harmless Pixelsites from any claims, damages, or expenses (including reasonable legal fees) arising out of Your Content, your use of the services, or your violation of these Terms or any third-party rights.
15. Termination
You may cancel at any time as described above. We may suspend or terminate services if you breach these Terms, fail to pay, or use the services unlawfully. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
16. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in California.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our services after changes take effect means you accept the updated Terms.
